Terms and Conditions.
1. General provisions
If the consumer purchases goods or services through the mentioned website, then such mutual agreement is considered as a Distance contract and is subject to the legal norms of the Republic of Latvia regulating the Distance contract, including, but not limited to "Consumer Rights Protection Law" of the Republic of Latvia, the regulations of the Cabinet of Ministers of the Republic of Latvia, etc.
2. Purchase process
Prices and specifications of products sold in the online store are indicated near products.
To place an order, add the desired products to your shopping cart. Fill in all the required fields and choose the most suitable delivery method. The total cost of the order with delivery will be displayed on the screen. Make a purchase payment to complete the order.
3. Payment terms
The payment currency on the site is the euro. The purchase can be paid for by choosing the following payment methods provided by the payment platform ______________, _______________:
• Latvian internet bank payments: Swedbank, SEB, Citadele, and Luminor.
• Visa / Mastercard card payments.
• Other European Union banks.
NB! Using the internet banking payment method, that is necessary to confirm the order and click the “return to the merchant” button.
Personal data required for making payments is transferred to the licensed payment institution _______________.
The contract comes into force upon successful payment to the bank account of the online store. If for some reason it is not possible to execute the order, the Buyer will be informed about it and the amount paid will be refunded as soon as possible, but no later than 14 days after receipt of the notification.
4. Delivery terms
The goods are delivered to the European Union countries. Purchased goods are delivered via parcel partner or courier service. All fees and taxes to be paid to receive the parcel at the destination of delivery must be paid by the Buyer. Shipping costs are displayed before order confirmation. Purchased goods are delivered to the address specified by the Buyer 2 - 14 within working days. In exceptional cases, we have the right to send goods up to 45 calendar days, informing the Buyer about it in advance.
5. Right to refuse
The Buyer has the right to cancel ant return the goods within 14 calendar days from the moment of receipt of the goods. The right to refuse does not apply if the Buyer is a legal entity.
To use the 14-day right of refuse, the goods may be used only for their intended purposes, the Buyer is responsible for maintaining the quality and safety of the goods during the period of exercise of the right of refusal.
If the goods are inappropriately used or damaged, during use by negligent handling of the product or failure to comply with the instructions, if the original packaging of the product has been lost, or if the packaging has been significantly damaged, the online store has the right to reduce the amount to be refunded following the decrease in the value of the goods.
To use the Right of refuse, the Buyer must submit a withdrawal form, which can be requested here: https://oilproject.lv/contact-us / sending it to an email address email@example.com within 14 days after receipt of the goods. The Buyer shall pay the cost of returning the goods unless the reason for the return is that the goods do not comply with the order (for example, an incorrect or defective product).
The Buyer is obliged to return the goods to the seller without delay, but no later than 14 days after sending the refusal form to the online store. Upon receipt of the returned goods, the online store shall immediately, but no later than within 14 days, refund all payments received from the Buyer based on the Distance contract.
The Seller has the right to withhold payment until the receipt of the goods from the Buyer or proof of Return of the goods. If the Buyer has chosen a different way of sending than the cheapest type of shipment offered by the online store, the online store is not obliged to compensate for the excess shipment costs.
The online store shall not be liable for delays or non-fulfillment of obligations or other non-fulfillment resulting from circumstances and obstacles beyond the reasonable control of the online store.
The online store reserves the right to refuse to sell the goods and demand the return of the goods from the Buyer if the price indicated in the online store is significantly less than its market price due to an error.
6. Consumer rights if the product does not comply with the agreement
The online store is responsible for the non-compliance of the goods sold to the Buyer with the Terms of the contract or deficiencies that occurred within 6 months after the date of delivery of the goods, or was at the time of delivery if such an assumption does not conflict with the characteristics or deficiency of the thing. The Buyer must inform the Seller about the non-compliance of the goods immediately, within 2 months after its detection, i.e. file a complaint. The Buyer can make a complaint by contacting the online store by e-mail firstname.lastname@example.org.
The online store is not responsible for defects that have occurred after the delivery of the goods to the Buyer. If the purchased goods have shortcomings, for which the Seller is responsible, the Buyer has the right to demand the elimination of the shortcomings of the goods or exchange for new ones free of charge.
If it is not possible to repair or replace the goods, the Seller returns to the Buyer all payments provided for in the Distance contract. The Seller shall provide a written response to the Buyer's complaint within 15 days.
7. Personal data processing
The online store processes only the personal data that the Buyer has entered during the ordering the goods process, such as name, surname, e-mail, etc. The online store transfers personal data to the transport service provider/s to ensure the appropriate delivery of goods.
If you have agreed to receive our marketing communications, including newsletters, we may contact you from time to time by sending you information about our services and the latest offers. For this purpose, we may process the email address that you provided when signing up for marketing communications. The Buyer has the opportunity to refuse to receive the marketing materials by notifying us by e-mail email@example.com.
8. Dispute settlement procedure
In matters not mentioned in current Terms and conditions, the Buyer and Seller undertake to comply with the laws and regulations in force in the Republic of Latvia. The parties shall resolve any dispute between the Seller and the Buyer by mutual negotiation or correspondence. If the dispute cannot be resolved by negotiation or correspondence, the parties will further resolve the dispute in the Court of the Republic of Latvia, observing the laws and regulations of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Centre (CRPC) or the Court of the Republic of Latvia.
The Buyer has the right to apply to the European Union dispute resolution authorities.
